Terms of Service

These Terms of Service govern your use of bestcarshippingcanada.com. The Site is an information directory about car shipping in Canada: we list companies and publish estimates and guides, but we do not ship cars and are not part of any deal you make with a company.

Who we are and accepting these terms

bestcarshippingcanada.com (the “Site”) is operated by Best Car Shipping Companies (“we”, “us”, “our”). “You” means anyone who visits or uses the Site, including people looking for a car shipping company and companies listed on it.

By using the Site, its tools or an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least the age of majority in your province or territory to create an account or submit a quote request.

What we are — and what we are not

  • The Site is an independent online directory and source of general information about car shipping in Canada.
  • We are not a motor carrier, freight broker, freight forwarder, dispatcher, insurer, law firm or government agency. We do not arrange, book, transport, insure or store vehicles, and we do not take payments for shipping.
  • We are not a party to any quote, booking, contract of carriage, bill of lading, payment or dispute between you and any company, and we do not act as anyone’s agent or representative.
  • We are not affiliated with or endorsed by Transport Canada, any provincial or territorial transport ministry or licensing body, the U.S. Federal Motor Carrier Safety Administration (FMCSA) or any other government body.

General information, not advice

  • Guides, provincial rules, FAQs, checklists and tool results on the Site are general information. They are not legal, insurance, tax or other professional advice and may not fit your situation.
  • Registration, inspection, insurance and other rules are set by each province and territory and change over time. Before you act on anything you read here, confirm it with the official source and, where needed, a qualified professional.

Prices and estimates

  • Prices on the Site — including the cost calculator, route guides, city and province pages and truck-versus-rail comparisons — are estimates in Canadian dollars, calculated from road distances, typical market rates and published third-party rates. They are not quotes, offers or guarantees from us or from any company.
  • The actual price, taxes, transit time and terms of any shipment are set only by the company you book with. Always get a written quote before you book.

Company listings and the “verified” label

  • Listings are compiled from information companies publish, public registries and what companies submit to us. Descriptions on listings are summaries we prepare from that information. Companies are responsible for holding every licence, safety certificate (such as an NSC number or CVOR certificate), registration and insurance their business requires.
  • A “verified” or similar label means only that, at the time of our check, the information described on our How we check companies page matched the sources we checked. It is not an endorsement, recommendation or guarantee of any company’s licensing, insurance, honesty, prices, safety or service, now or later.
  • Companies may be on different listing plans, which can change where and how a listing appears (for example, its position or a highlighted card). Position, badges and plans are not a ranking of quality.
  • Company names, logos and trademarks belong to their owners and are shown only to identify the company. A company that wants its listing corrected, its logo removed or its listing taken down can contact us at the address below.
  • Choosing, contacting, paying or relying on a company is your decision. Check the company’s safety certificate and insurance and read its contract before you book.

Quote requests

  • When you send a quote request through the Site, we pass the details you enter to the company you chose so it can reply. If that company has not yet claimed its listing, the request comes to us first and we decide whether to pass it on by hand. We do not guarantee that any company will reply, offer a price or accept your shipment.
  • Any quote, booking, contract, payment, shipment or dispute is solely between you and that company. Contact the company — not us — about pickups, delivery, damage, delays, refunds or claims.
  • Do not use quote forms to send spam, false requests or anything other than a genuine request for car shipping.

Accounts, claims and companies’ obligations

  • Keep your login details secure and tell us promptly about any unauthorised use. You are responsible for activity under your account.
  • Only claim or manage a listing for a company you are authorised to represent. We may ask for proof and may refuse or reverse a claim.
  • Companies must keep their listing accurate and lawful, and must not make false or misleading claims about their prices, licensing, insurance, services or experience. Companies are responsible for complying with all laws that apply to them, including transport, consumer protection, competition, privacy and anti-spam laws, when they deal with customers who reach them through the Site.
  • By submitting content (such as a description, photos or a logo), you confirm that you have the right to do so, and you give us a non-exclusive, royalty-free, worldwide licence to host, display, adapt and publish it on the Site and in its promotion for as long as it is listed.
  • We may edit, refuse, suspend or remove any listing, content or account to keep the directory accurate and safe or if we reasonably believe these Terms or the law have been broken.

Plans and payments

  • Listing a company on the Free plan costs nothing.
  • Paid plans (Pro and Premium) are not available yet. When they are, their price in Canadian dollars, applicable taxes, billing period and cancellation terms will be shown on our plans page and at checkout, and those terms will apply to your purchase.

Acceptable use

You agree not to:

  • use the Site for anything unlawful, fraudulent or misleading;
  • post false, defamatory, infringing or offensive content, or impersonate a person or company;
  • scrape, copy or download the Site’s content or data in bulk, or use automated means to access it, except search engines indexing public pages;
  • try to gain unauthorised access to the Site, its accounts or systems, or interfere with its operation or security;
  • use contact details from the Site to send unsolicited commercial messages.

Our content

The Site’s text, design, data compilations, estimates and software belong to us or our licensors and are protected by copyright and other laws. You may view and share pages for personal, non-commercial use. Photos credited to third parties are used under their licences, shown next to each photo.

Third-party information and links

  • Some information comes from public sources and third parties, such as government registries, FMCSA records, published rate information and Wikimedia Commons. We show it as we find it; it may be delayed, incomplete or wrong.
  • The Site links to websites we do not control, including company websites and government sources. We are not responsible for their content, practices or availability.

Disclaimer

To the extent permitted by law, the Site, its content, tools, estimates and listings are provided “as is” and “as available”. We do not promise that the Site will be uninterrupted or error-free, or that any information on it, including any listing, estimate or rule, is accurate, complete or current.

Limitation of liability

To the extent permitted by law, we and our owners, operators, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Site or these Terms.

To the extent permitted by law, we are not liable for (a) loss of or damage to any vehicle or property, delays or costs related to any shipment; (b) the acts, omissions, statements, prices, services or insolvency of any company or other third party, whether listed on the Site or not; (c) decisions you make in reliance on the Site, its tools or content; or (d) errors or delays in third-party information.

To the extent permitted by law, our total liability for all claims relating to the Site or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim arose and CA$100.

Indemnity

To the extent permitted by law, you agree to indemnify us and our owners, operators, employees and contractors against claims, losses and reasonable legal costs arising from content you submit, your misuse of the Site or your breach of these Terms or of the law. If you are a company, this includes claims by customers arising from your services.

Your rights as a consumer

Nothing in these Terms limits or excludes any right or remedy you have under consumer protection law in your province or territory that cannot be limited or excluded by contract. The disclaimer, limitation of liability and indemnity sections above apply to consumers only to the extent that law allows.

Quebec consumers: where Quebec’s Consumer Protection Act applies, the clauses of these Terms that limit our liability, exclude warranties, require you to indemnify us or choose a jurisdiction do not apply to you to the extent that Act prohibits them, and you keep your right to bring a claim before the courts of Quebec.

Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to your rights as a consumer, any dispute will be heard by the courts of Ontario. If you are a consumer, you may also bring a claim in the courts of the province or territory where you live, where the law gives you that right.

Before starting a formal claim, please contact us so we can try to resolve the issue informally.

Changes, suspension and general terms

  • We may change the Site or these Terms. We will post the updated Terms on this page with a new “Last updated” date and, for significant changes, give notice on the Site or by email before they take effect. Changes do not apply to a dispute that arose before they took effect.
  • We may suspend or end access to the Site or an account to protect the Site, its users or our legal rights.
  • If any part of these Terms is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest remains in effect. Not enforcing a provision is not a waiver of it.
  • These Terms, our Privacy Policy and any plan terms shown at checkout are the entire agreement between you and us about the Site. Headings are for convenience only.
